Claims determine who gets paid in a bankruptcy. This session covers what is included in claims, when to object to claims, and how knowledge of the claims rules can help your clients.Sponsored by Solutions In Health Care Management

This panel of bankruptcy judges from the Eighth and Tenth Circuits discusses several recent decisions from the U.S. Supreme Court, the Eighth and Tenth Circuit Courts of Appeals and Bankruptcy Appellate Panels, and elsewhere that are likely to impact your bankruptcy practice.

This panel explores the current state of the law around § 523(a)(8), focusing on the agreed hardship discharges of certain federal student loans under the guidance issued by the Department of Justice and the Department of Education. While walking attendees through the new standards, the panelists will provide practical advice and practice pointers on how to gather information, from the client interview to external resources to assist the client in collecting loan and payment history information, and how to correctly complete both the complaint and, where appropriate, the attestation form.Sponsored by Bryan Cave Leighton Paisner LLP

This panel discusses how the Supreme Court will, or should, rule on Purdue in deciding whether bankruptcy courts may issue nonconsensual, nondebtor releases of creditors’ direct claims. The panelists also analyze other issues where the courts are split, such as whether subchapter V debtors have nondischargeable debts, the correct approach for calculating the amount of a capped claim on the rejection of a long-term lease, whether a discharge bars future liability on a personal guarantee, and who gets appreciation in the value of a home post-filing if a chapter 13 debtor converts their case to a chapter 7.
