This panel discusses how the Supreme Court will, or should, rule on Purdue in deciding whether bankruptcy courts may issue nonconsensual, nondebtor releases of creditors’ direct claims. The panelists also analyze other issues where the courts are split, such as whether subchapter V debtors have nondischargeable debts, the correct approach for calculating the amount of a capped claim on the rejection of a long-term lease, whether a discharge bars future liability on a personal guarantee, and who gets appreciation in the value of a home post-filing if a chapter 13 debtor converts their case to a chapter 7.
